Design plans, drawings, and concepts remain the property of Designs by ChrisKurt unless otherwise agreed in writing.

Site Conditions & Unknown Factors

Project pricing and timelines are based on visible and reasonably known conditions. Subsurface issues, drainage complications, utility conflicts, poor soil conditions, or other unforeseen factors may require adjustments to scope, cost, or schedule. We will communicate any changes before proceeding.

Scheduling & Project Timeline

Project scheduling is subject to availability, weather, material delivery, and project sequencing. While we aim to stay on schedule, delays can occur due to factors outside of our control.

Payments & Deposits

Payment terms will be outlined in your proposal or invoice. By approving a project, you agree to those terms.

Deposits may be required to secure materials, labor, and scheduling. Late payments may result in project delays, additional fees, or suspension of work.

Cancellations & Changes

If you need to cancel or modify a project, reasonable notice is required. Deposits may be non-refundable depending on project stage, material orders, or work already completed. Changes to scope after approval may result in additional costs and timeline adjustments.

Client Responsibilities

Clients are responsible for:

• Providing accurate property information and access to the site

• Identifying property lines where relevant

• Securing any required HOA approvals or municipal permits unless otherwise agreed

• Ensuring pets, vehicles, and personal items are clear of work areas

Materials & Planting

Plant material and natural elements are living and subject to environmental conditions. While we select and install quality materials, we cannot guarantee plant performance due to weather, soil conditions, watering practices, or maintenance after installation. Warranty terms, if offered, will be outlined separately.

Maintenance & Ongoing Care

Proper maintenance is critical to the performance of any landscape installation. Unless a maintenance agreement is in place, ongoing care is the responsibility of the property owner.
